The Whacked Judicial System: The Judicial Qualification Commission Has No Respect for Citizens and Seems To Allow Judges To Misapply The Law

THE JUDICIAL QUALIFICATIONS COMMISSION HAS BEEN AROUND SINCE 1968 AND THERE HAS NEVER BEEN A SINGLE INVESTIGATION FOR INTENTIONAL MISAPPLICATION OF THE LAW OR GROSS NEGLIGENCE/INCOMPETENCE.

What does Florida Judicial Qualifications Commission (JQC ) think of complainants? The JQC is where you report judges behaving badly. The 2014 annual report is linked at the end of this article. Everything quoted here comes directly from the JQC.

"A great majority of complaints received by the Commission merely seek review of judicial decisions or

rulings. The Commission has no authority to review rulings, since that is the province of the appellate courts."

Judges do not write law but a judge can essentially write law from the bench by intentionally misapply the law under the guise of "judicial error". There is no forum for addressing multiple errors by judges.

1. How many errors are judges allowed to make?
2. Is there a method for tracking judges errors? NO
3. Why are litigants forced to pay monies because of judges errors?

If a judge enters an erroneous order, a person has to pay an attorney $350 or more an hour to correct. If a litigant does not have the money within a certain amount of time then they have to utilize the Appellate Process.

An Appeals attorney retainer is $10,000- $20,000 to start. It doesn't make sense the judge made the error but litigants have to spend thousands of dollars to correct a "judges error".

Many of the errors judges make are from lack of attention to detail or intentionally misapplying the law which indirectly gives judges the ability to write law from the bench. In Civil cases judges know how much money and assets litigants have because litigants submit financial affidavits to the court. A judge knows what litigants will have the financial resources to appeal or address the judge's decision.

"Kids for cash" in Pennsylvania is one example of what confidentiality of judicial complaints enable.
